Terms and conditions

These terms and conditions are intended to clearly define the terms governing the booking, participation, cancellation and organisation of Kween Gallery workshops, in order to provide a transparent and respectful framework for all participants, models, photographers, partners and organisers.

1. Purpose and Organiser

These terms and conditions govern participation in workshops and photographic events organised under the name Kween Gallery.

Booking a place constitutes acceptance of these participation terms and conditions.

 


2. Organisation and Collaborations

Certain workshops may be organised in collaboration with one or more photographers, models, studios, venues or other partners.

Where several parties are involved in the organisation of a workshop, their respective roles and responsibilities are defined separately between the organisers.

Unless otherwise communicated to the participant, Kween Gallery is the primary point of contact for registration, payment and information relating to the workshop.

Participation in a workshop does not automatically create a contractual relationship between the participant and the various service providers or collaborators involved in its organisation.

 


3. Booking and Payment

Workshop bookings are made directly through the Kween Gallery website. Payment of the full amount indicated on the workshop page constitutes confirmation of the registration.

Payment in two instalments:
If a participant wishes to pay for their registration in two instalments, they must make a prior request by email to Kween Gallery at the official email address indicated on the website.

Upon approval by Kween Gallery, an initial payment corresponding to 50% of the total workshop price will be required to confirm the booking. The remaining 50% must be paid no later than 4 weeks before the workshop start date.

A booking is considered confirmed only once the payment corresponding to the terms agreed with Kween Gallery has been received.

As places are limited, registrations are processed in the order in which payments are received.

If the remaining balance is not paid within the specified deadline, Kween Gallery may cancel the booking and allocate the place to another participant. Any amounts already paid remain subject to the cancellation policy set out in Section 4.

 


4. Cancellation and Refund Policy

Any cancellation request must be submitted in writing to Kween Gallery by email. The date and time at which the email is received by Kween Gallery shall be deemed authoritative.

Refund conditions are determined according to the period between the date on which the cancellation request is received and the workshop start date.

1. Cancellation 6 months or more before the workshop — 100% refund

Any cancellation request received on the date falling exactly 6 months before the workshop start date or earlier entitles the participant to a 100% refund of the total amount actually paid.

2. Cancellation less than 6 months and 2 months or more before the workshop — 50% refund

Any cancellation request received after the date falling 6 months before the workshop start date and up to and including the date falling exactly 2 months before the workshop start date entitles the participant to a 50% refund of the total workshop price.

This refund corresponds to 50% of the total workshop price, and not 50% of the amount already paid.

3. Cancellation less than 2 months before the workshop — no refund

Any cancellation request received after the date falling 2 months before the workshop start date does not entitle the participant to any refund, regardless of the amount already paid.

Refunds will be made using the same payment method used for the booking, where technically possible.

In the event of payment in two instalments, these refund rules apply to the total workshop price, regardless of the amount already paid at the time of cancellation.

 


5. Cancellation or Modification by Kween Gallery

Kween Gallery reserves the right to cancel, postpone or modify a workshop when exceptional circumstances so require, including in cases of force majeure, the unavailability of a venue or essential participant, weather conditions incompatible with the planned activities, or any other circumstance beyond the organiser’s reasonable control.

In the event of the definitive cancellation of a workshop by Kween Gallery, amounts paid for the booking will be refunded in accordance with the arrangements communicated to participants.

In the event of postponement, a new date may be offered to participants. The applicable arrangements will be communicated directly to them.

The programme, schedule, venues, models, photographers or other contributors may be changed where necessary for the proper organisation of the workshop.

A reasonable modification to the programme that does not substantially alter the nature of the workshop does not necessarily constitute a cancellation.

 


6. Programme and Included Services

The services included in the price are those indicated on the workshop page at the time of booking.

Depending on the workshop, these may include:

  • access to the various photographic sessions;
  • the presence of professional models;
  • artistic direction or creative guidance;
  • access to shooting locations;
  • accommodation;
  • meals;
  • transportation provided during the workshop;
  • styling and/or wardrobe;
  • activities or services specifically mentioned in the programme.

Services not expressly stated as included are considered not to be included.

Flights, transportation to the meeting point, personal insurance, personal expenses and any other costs not expressly indicated remain the responsibility of the participant.

 


7. Participant Responsibility and Conduct

Each participant is responsible for their conduct throughout the entire duration of the workshop.

Participants agree, in particular, to:

  • respect other participants, models, photographers, organisers and service providers;
  • respect the venues where the workshop takes place;
  • follow instructions given by the organiser;
  • respect the boundaries and consent of models;
  • refrain from violent, discriminatory, harassing, sexual or inappropriate behaviour;
  • not touch a model or another person without their explicit consent;
  • not intentionally disrupt the photographic sessions.

Kween Gallery reserves the right to immediately exclude any participant whose behaviour compromises the safety, respect or proper conduct of the workshop.

An exclusion resulting from the participant’s behaviour does not entitle the participant to any refund.

 


8. Safety, Health and Insurance

Participants are responsible for their own physical condition and their ability to take part in the activities offered as part of the workshop.

Participants are responsible for informing Kween Gallery, prior to the workshop, of any information that it would reasonably be necessary to know for the safety or organisation of their participation.

Each participant is responsible for taking out any insurance they consider necessary, including:

  • health and accident insurance;
  • personal liability insurance;
  • travel insurance;
  • cancellation insurance;
  • insurance covering personal belongings and photographic equipment.

Kween Gallery shall not be held responsible for consequences arising from personal circumstances or conduct for which the participant is responsible.

 


9. Personal Belongings and Photographic Equipment

Each participant is responsible for their photographic equipment, personal belongings, travel documents, money and valuables.

Kween Gallery shall not be held responsible for their loss, theft or damage, except where liability is imposed by law.

Participants are responsible for any damage they intentionally or negligently cause to venues, equipment, vehicles or property made available to them.

 


10. Photography, Video and Image Rights

Photographs and/or videos may be taken during workshops by Kween Gallery, its collaborators, photographers or service providers, including for communication and promotional purposes relating to Kween Gallery.

By participating in the workshop, participants acknowledge that they may be photographed or filmed as part of the event. Content in which a participant appears may, in particular, be used on the Kween Gallery website, social media platforms, communication materials, portfolios or for the promotion of its workshops.

Kween Gallery undertakes to use such content in a context related to its activities and with due respect for the person represented.

If a participant does not wish to appear in Kween Gallery’s communication or promotional content, they must inform Kween Gallery in writing before the beginning of the workshop.

Photographs taken during the shooting sessions are subject to the applicable copyright and image rights of the photographers, models and other persons or entities concerned. Where necessary, the conditions relating to the creation, use, publication and exploitation of the images are defined in the Photographer / Model Agreement applicable to the workshop.

Participation in the workshop does not grant participants any automatic rights to photographs taken by other participants, models or photographers present at the workshop.

 


11. Use and Publication of Photographs Taken During the Workshop

Photographs taken by participants during the workshop remain subject to applicable copyright and image rights.

Participants agree to comply with the conditions communicated by Kween Gallery regarding the use and publication of images, as well as with the rights and permissions granted by models and other persons represented.

Where a workshop is subject to a Photographer / Model Agreement, that agreement supplements these terms and conditions and specifies, in particular, the rules applicable to the use, publication and exploitation of photographs taken during the sessions.

Unless otherwise authorised, participation in a workshop does not automatically grant the right to use photographs for advertising, commercial or promotional purposes on behalf of a third party.

Participants remain responsible for the use and distribution of the images they create, as well as for respecting the rights of the persons and locations represented.

 


12. Data Protection, Applicable Law and Dispute Resolution

Personal data provided during registration is used for the purposes of managing the booking, organising the workshop and, where applicable, Kween Gallery’s communications, in accordance with the information provided to the participant.

Personal data will not be disclosed to third parties for purposes unrelated to the organisation of the workshop without a legal basis or consent where such consent is required.

These terms and conditions are governed by Swiss law, subject to any mandatory provisions that may apply.

In the event of a disagreement or dispute, the parties agree to first seek an amicable resolution.

Kween Gallery reserves the right to update these terms and conditions. The terms and conditions applicable to a participant are those accepted by the participant at the time of booking.
